Now we know how Tom Paine felt at Valley Forge. It has been a cold December for those who think immigration is good for America. On December 16th, the House of Representatives approved the Border Protection, Antiterrorism and Illegal Immigration Control Act of 2005(H.R.4437), perhaps the most draconian bill of recent memory, and, a mere three days later, the House approved an agreement with the Senate on a comprehensive budget reconciliation package stripped bare of any pro-immigration provisions. While there is some satisfaction in the fact that the House did not get the higher L fees that it sought, this is cold comfort. Truth be told, it was a tough week, the worst in a long time, and the shock among pro-immigration circles, both on Capitol Hill and beyond, is palpable.
Removal of Section 8001 from the Budget Reconciliation Conference Report can be a temporary setback if we play our cards right. Congressman Sensenbrenner has long and loudly proclaimed that he is not against all immigration, just the illegal variety. Fine. Let�s take him at his word. He is, after all, the architect of the new E-3 visa that enables 10,500 Australians to get around the H-1B cap. Congressman Sensenbrenner has his enforcement-only bill now so he should be prepared to support us when we seek to attach Section 8001 to broadly bipartisan legislation in the upcoming session of Congress. If Congressman Sensenbrenner means what he says, and he usually does, this might be a golden opportunity to bring Section 8001 back to life.

We are happy and proud to anounce that we are a 3000+ members family now. Kudos to the all the members for the hard work and perseverance. We are happy with what we have achieved so far and are confident & determined to do our best in the future. I want to quote Sunil on this

The University Relations Committee will be responsible for educating university students about the advantages for them to join the IV efforts early on and increase our membership with active members from various universities.

From your post it is not clear if your 140 is already approved or pending.
Anyhow, assuming it is approved and he cancels, then an RFE is bound to come, it is best to file for AC21 with new employer, since RFE could also involve EVL with recent paystubs................. now since in your case even your new job is with a consulting company (do not know how big it is), you might get stuck with RFE too.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.

Has anyone tried extending NJ DL using H1b extension receipt ?
My H1b extension is in VSC and looks like it will take long long time to come back....DL is expiring in 30 days, with EAD my renewal would be for 6 months only as EAD also expires in Aug.
wonder if they will accept H1b receipt with employer letter ?
please share your NJ DL experience.

Looks like NSC is sending EAD cards in a 'first filed first served ' sequence. I have been monitoring this with my friends circle, where EAD is issued in chronological order. About a few weeks ago, one of my friends received EAD for his July 24th filing, a week ago an Aug 6th filer received EAD card, Last week Aug 8th and 13th filers received EADs.
I filed on Aug 10, but no EAD yet for me. Anybody who filed before Aug 13, didn't receive EAD yet?
I filed my 485 on July 18 at NSC. The checks got cleared only last week at TSC. Looks like my 485 was tranferred from NSC to TSC. So, will I be having problem in getting my EAD, as my 485 is filed at TSC now, and EAD is at NSC.
Please respond your views.

How can you change jobs if you have not filed for I485 and it has not been pending for >6months?
If you change jobs you will have to start green card process again.
If you stay with your current company, and if PD becomes current in summer, they can file for 1485 and then once your i485 is pending for >6 months you can try to change jobs using AC21.

Dont count on it. There is very narrow chance. If you opt CP in 140, NVC will send your papers to consulate abroad, only after your PD become current. Consulate will take their own time to arrange the interview. It will take one month to six months after they recive your file from NVC. During that period the PD has to be always current. Consulate takes out visa numbers for CP, only after a successful interview. If your PD retrogress with in a month (like last year fiasco) consulate will not schudle a interview till it become current again. In that case your file will stuck for ever. Therefore, 485 is the best route. CP is the best route, only if the cutoff dates does not flutuate or retrogress back.

i submitted my 485 one month ago but still haven't got receipt. I just got a new job offer from a big company, which i really dont want to reject. if i transfer my h1b now, will be 485 get rejected immediately? or my h1b transfer will be rejected? thanks for your advice!

I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?
Let your lawyer confirm this: Get your I140 approval, if possible by using premium filing. File for a 3 year H1 extension. After extension, transfer H1 to new employer. Start GC process with new employer but maintaining your PD since your old employer aill not revoke your I140.
