My Labor is stuck in Atlanta processing center.... It is frustrating to see people getting approvals in 2 days from Chicago center.
While people who apply to Chicago today, can file 485 by July, I'm gonna miss the boat :eek:

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

I used the AR-11 form for the change of my address. I did it online. Also, while changing there is an option to change the address for any pending petition. In my case it is the I-485, which I changed.
My question is, how to verify if the address has actually changed in the system at USCIS. I checked my case status online and did not see any LUD's.
Please let me know if anyone of you have done the change of address and share your experience.

Hi All,
This is forum for LC Sub cases. I'm on last phase of my L1B(5 years would complete on 2009) so my company a large corp evaluted my case as fit for LC Sub and applied I-140 on July 4th and 485 on July 27.
I have no status on my I-140/485 or 131 since got the Receipts. Got EAD.
Even after my FP the case also was not updated.
Question:
If you have filed your I-140 LC Sub are you seeing any progress on your file?
If yes, which date your I-140 was applied?
Was that standaline or Join filing with I-485?
Which Service center is handling your case?

You message is not clear. Are you saying he cannot work without getting a new H1. If he needs to get a new H1, then he needs to go out of the country for more than a year and come back later with a new H1.
I beleive, he can do H1 transfer. By the way, the new company should also start your labor and I140. Still you can port your PD if you have already 140 approved.
There is nothing tricky, it is plain and simple: you want to switch jobs?
You have to apply for a new H1. You absolutely cannot use your current H1 to work any other job.

We did the exact same thing. We informed officer that my wife's Extension is pending, he said that's fine and gave her I-94 valid for 40 days (time remaining on her H4 visa).
After she get her I-94 for 40 days then if her new H4 application is approved then she will get the extension of her I-94.

Jim & Cathy, thanks a lot for the advice. These are "golden rules" that I have always followed, although with no such great results, it seems.;)
I'm new to this forum, but have been quite a photo buff since I was 15 or so (47 now..already !!). Went thru the usual collection of 35 mm (Yashica, Canon, Mamiya, Nikon). Couple of months ago bought a Fujifilm S7000. Quite satisfied with it even though the performance is still not comparable to the one that can be obtained with a true reflex. (I'm planning to upgrade shortly, not very sure to what yet, since I don't want to spend more than $ 2 k -advice appreciated).
The pics i posted where an attempt to make some portraits a bit different from the classical; that is to picture the subject in his/hers environment. It's a new area for me, but which I find I like a lot.
Here is a set of more "classical" portraits of my kids. As always I appreciate your comments.

Hello All,
I applied EAD for my wife in Dec Last Week. Case is still pending with USCIS. I have to move to a different state due to job change. I have put a forwarding adress with USPS. All my mail are getting forwarded.
My question is if EAD is approved will it also get forwarded to my new address as other mail or do i need to submit a change of address with USCIS.
Did any one faced this situatin before? Please advice and share your experiences.

This is indeed good news, how long can we stay in dark, we should all know at what stage we are at, as of now I do not know if my case has been pre-adjudicated or not, have background check done or not ??.

You've been approved per your message below. So all it means in your case is that the USCIS has to let the Visa Center and/or Dept of State know that.

Do I need to send the copy of visa stamp even if my stamp has expired and I am working on EAD? (my I-797/I-94 expired too).
Can someone please answer this as I need to apply for ead renewal soon.

It seems people who applied for AP in TSC are getting their APs faster, compared to those who applied at NSC.
Refer processing times at https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC and search for "All other applicants for advance parole". Right now they are processing July 03, 2007 cases.

You actually were out of status since Dec 30 till this moment and you still are out of status. You are immediately out of status once you are not paid for the job or fired, regardless of the fact if employer revokes H-1 or not.
You can not do H-1 transfer any more. Your next H-1 petition will be a new petition but you will not be subject to H-1 cap as you already have been counted for 6 years.
So I presume it would safe to get a job offer and leave as soon as possible, then wait for the H-1 petition get approved, stamp H-1 visa and get back.

I'll throw in my very non-expert opinion here, having shot just a few weddings basically in your position.
The dress in the first shot is blown out. I might have angled the vertical dimension a bit lower to capture the full length portraits and avoid so much "dead space" at the top.
The composition on the second one is ok, but the eyes are rolling all over the room (bad grammar intentional). Since I've never shot in a paid position where I had the authority to exclude other photography during the group shots (not that I would even then), I generally defer first to the "guest" photographers, telling everyone to take their turn one at a time, and to speak up before the photo to get the subjects looking at them. Then I take over the attention and get everyone to look at me for however many shots I need to take of that pose. BTW, it's always good to take a few shots of each pose, because you're almost guaranteed to have closed eyes in different shots. I'm sure the pros will be in shortly to fill us both in on a better way to do this (I'd appreciate that, too). :)
The fill flash was done excellently, but the background is very contrasty and thus distracting.

It looks like you are getting glare from glass or something. Get as close to the glass as you can and the lens as perpendicular as possible. A dark cloth and duct tape to put it up with would get you two things: (1) ability to block glare from lights behind you and (2) hide you from the birds so they settle down.
I've actually put the camera on a tripod and draped a large towel over it and my head/torso for camoflage, which let me stand outdoors and get closer without scaring them away. But I don't do that much because it's really tiring standing there, motionless :)
For the most part, a flash doesn't seem to bother birds much and it's a great help - you get better contrast and a faster shutter.

I-140 has been approved. Our priority date is in May 2008.
The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?

With a priority date of May 2008 EB3-India, unless there are legislative changes (or another July 07 fiasco) you are expecting a wait of atleast 4-5 years before you can file your 485 and get an EAD. Perhaps longer, considering how EB3 is ~8 years backlogged.
Your best bet would be get H1-B sponsorship.
