Hi pkrg21,
So before I-485 becomes current, as long as I-140 gets approved, then we are okay to lose current job, either laid off or change job? I think I-140 approval doesn't take long, right? It's just I-485 takes forever?
I'm quite new to this process. My employer just filed Labor Certificate last week. I'm also a little worried if my employer goes bankruptcy some day.

No the process must be completely restarted if you loose your job after I-140 approval.The only thing you get is the priority date.If your I-485 is already applied and it is pending for 180 days then there is no issue and you are safe.

Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
They never sent any notice to lawyer or me about this.

Hello,
You can not (lawfully) re-enter on an H1B, as you're out of status. If you get caught lying at the border, you will be turned back and will likely be permanently barred from entering the U.S. You'll want to re-enter on an H4 visa - you dont need an H4 petition, although obviously you'll need to qualify for the H4, so be prepared to document your spouse's H1 approval and valid status.
Are you stating that you were laid off (thus overstaying), or that you were benched without pay (meaning your employer should have been paying you)? With more than 90 days out-of-status, you may have triggered a period of ineligibility to re-enter the U.S.
Given the apparent overstay issue, I suggest consulting an immigration lawyer.

Greetings,
I have a pending 485 application under EB3 category through my wife's application. However, recently her employer applied for the EB3-EB2 change since she already qualifies for EB2. I understand that the priority date remains the same. In our case the priority date is Feb 05. I wanted to know what will be the process going forward. Currently the EB3-EB2 application is on the PERM labor state. Once that gets approved does it mean that our I485 will be adjudicated immediately since for EB2 the priority date has already gone past ours (feb 05)? Or we will need to then apply for another I-140?
If anyone knows the process of EB3 to EB2 transfer can he/she kindly post it?

Get the police record and DA office record. . If the record shows that no charges were pressed, you can submit that. Check if DA's office can give you a letter.
You can also try obtaining a letter from the court indicating that their record did not have anything on you.

Hi all,
I submitted an application via premium processing for EB-1a with USCIS at the Texas Premium Processing Centre last month (April 2007).
I received an RFE notification via letter after two weeks listing the requirement of further evidence against 3 out of the 8 criteria I submitted.
I can submit further evidence - but my question is this ... "Why have they not made mention of the other 5 criteria I submitted" ? Has this failed ? Do they not matter ?. I am quite concerned because they have not made any mention of my other criteria ? Does anyone have any advice.

My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.
If she transfer her H1B to new company.
1. Can she ask for 1 year extension based on her pending labor ? Does she need to wait till the labor gets approved ?
2. Can she use Premium Processing for H1 transfer?
#1 - Yes, as long as the PERM is pending and at least 365 days old at the time of filing H1B extension
#2 - Yes, Premium processing available at the additional cost of $1000
If she transfer her H1B to new company.

In the meantime, lawmakers hope they can agree on a longer-term continuing resolution through September when this fiscal year ends."

I applied for H1B and Green Card Simultaneously in 2002. My first H1B expired in 2005. I am working on EAD. My questions are--
If I decide to change jobs and apply for H1B with the new company, am I subject to the QUOTA?
If I change jobs( in similar field) to another state in another service center, how is my case transfered to TSC from NSC?

Yes. You will get all the tax rebates. I remember getting the rebate check after 2001.

I have a green card and I'm thinking about living 50/50 in US and my home country Slovakia.
I've had GC for about 6 years and been living quite a travelling life spending more time outside US then in. Its also about 50/50 with trips always around 10mo in or out.My continuous residency is broken.
Do you think that if i live 50/50 in and out for five years they will give me citizenship with such history?
Got GC after Mom.

If you spend more than 180 days a year in the U.S (total of 2.5 years in the 5 years preceding to the application) and show ties to the U.S (a house, tax returns, family etc). If so, it should not be a problem. The U.S ties come into picture only when you are out of the U.S for a extended period of time (like in your current case). Good luck.
