Could you all please give me an opinion on this situation? I am trying to ask my lawyer, but I won't know for a few days and this is disturbing me a lot!
I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?

"Copy of visa page of passport in color " is listed as one of the supporting docs for ead renewal.(in the IV thread on EAD self filing)
Do I need to send the copy of visa stamp even if my stamp has expired and I am working on EAD? (my I-797/I-94 expired too).
Can someone please answer this as I need to apply for ead renewal soon.

Here is my situation . My visa status is H1b and i was laid off by a well-known software company and my termination date was 30th Oct 2009 .
I approached a software consultancy and they filed a LCA petition on 3rd Nov 2009 and applied for H1b transfer on 10th Nov 2009 . They received the EAC petition number on 3rd December 2009 . Meanwhile they kept trying a project for me . I have following queries
1. As i am not getting any salary from 1st Nov 2009 , what is my legal status ? Am i out of status and till what time i could stay here ? What could be effects if i stay here for long without project and salary?
2. Am i entitled to get any salary from current company (software consultancy) ? If yes , when shall they start paying me ?Can they really force me legally to stay here without salary as they might have an excuse that H1 is still not transferred and i am not their employee right now ? My 140 (filed concurrently with 485) was approved on Aug 17th. Ever since 08/17 I have been seeing LUD's on it everyday. In fact there was a LUP on 08/19 Sunday! Any ideas what's happening? I think something is going in CIS.
I got a LUD on my November 2005 approved I 140 on 03/13/08. My I 485 reciept date is August 7th, 2007. I got all reciepts, EAD and FP notices. I am in EB3 category. Need to know why LUD on I 140. :confused:

I am on H1-B, and about to apply for I140.
My wife has recently got a F1 visa (and her H4 visa has been left valid).
I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

Your wife's H4 is no longer valid since she switched to F1. You cannot hold non-immigrant status in two different classification at the same time. However, I think it is okay and even expedient that you mention her in your I-140.

The fact that the company that sponsored your GC shuts down or files for bankruptcy should not have any impact on you. As long as you have an approved I-140, an I-485 pending more than 180 days and a job offer in the same or similar occupation, you are protected by AC-21.
It would be prudent to make sure that you now have copies of all documents relating to your GC case, including complete copy of LC, I-140 petition and supporting docs, H petitions, pay records etc.

RFE's during I 485 - consolidated
I though it would be a good idea to start consolidating all the RFE's, so that people would have one thread to look at if at all there is any RFE

Technically yes. But USCIS looks at cases under a microscope when they see multiple applications from a same applicant. And if the the sponsor is a small firm, you can expect some careful screening. Increasingly USCIS is making efforts to ensure GC system is not abused by people. A lot of companies had in the filed for GC for several employees and GC applications for latter and sometimes former applicants were denied when it was found that the employer cannot show enough funds to support them. Take the risk only when you are sure. Lawyers will be happy to file multiple applications because they will get double their fees. BTW each lawyer generally makes you sign a contract beofre taking a case where the lawyer says that he cannot guarantee GC and if it is denied, lawyer takes no responsibility.

Unless the animation is created in another application such as illustrator, the files size for anything created within Swift such as text, squares, etc. take up a lot of space. But when I do use 3D in Flash (I don't use 3D all that much), I use Swift 3d.
When I publish the Swift 3D SWF file and import it into Flash, I often delete a keyframe from the animation every 2 or 3 frames. Each keyframe in a Swift animation is about 3-8KB each. For a fairly large 3d Shape that is being rotated, the file size could balloon even more. Anyway, deleting a few random frames does not degrade too much from the animation.
To help reduce the file size, I also select each frame of the Swift animation in Flash, and press the Smooth or Straighten buttons. That helps remove some of the extraneous artifacts that might degrade the look of the animation as well as take up a lot of space. I also Optimize the animation by removing extra curves, etc. by going to Modify | Optimize. Optimize is similar to using the Smooth and Straighten icons at times!

Mods, please remove my post (and maybe it would make sense to create threads specific to the USCIS/DOS mess up to - at the moment it does not look very organized to me and it is hard to find information. Maybe sub-threads with "law suit", "publicity" would channel comments better?)

I think this would be well worth a few minuted report - everybody is talking about the pain that the illegal immigrants go through but (without taking away anything from that), the pain of legal alliens having to deal with the willful behavior of USCIS and DOS is not much better.
