Incase of substitution the beneficiary has to sign the approved labor. Otherwise it is not required.

You can also go to your local immigration office and talk to an IO in person and show him all the proofs and press release from USCIS website.
They will be able to pull up your case and update the system with the details and make it as acceptable.

So how about a fax campaign in favor.
That should not be too distracting from rally preparations.

I got the magic mail today welcoming the new permanent resident.
It talks about ADIT processing(see below).
What does this mean?

They took her original 797 approval notice away....it did confuse her and also me.
She just got her stamped passport back in courier yesterday, but there was no 797 with it.
Should we contact the consulate for it?

A quick question on Canadian immigration(PR) - Can someone tell me as to typically how long the entire process takes if applied from US? Starting from aplying and getting the PR approved? thanks.
1. Download the form
2. Fill it
3. Supply all required documentation
4. If you did not live in the US in the past 5 years , if you lived elsewhere unless its india, you need to get the police report, for india they will do it.
5. You get all the transcripts of your college etc in sealed envelopes attested by the dept/school
6. Birth certificates, experience letters.
7. Send the application with the requisite fee, the form is easy to understand and fill, so you need no tutorial for that.
8. Once you file the application, right now based on the processing time, you will receive a letter assigning your application a file number. Keep this document , its very important.
9. Now your wait begins and it will last 48-52 weeks. 'YES' they will touch your file only after that much time. You will receive a request to complete medicals and fingerprints ( local police + any other private FP place ).
10. Once they receive all the information, you will be either called for an interview or you will directly get a letter saying send your passports for stamping.
11. Based on what you received( if interview is required you will go there to attend the interview) otherwise you send the pp and you will receive them stamped with immigrant visas.

Hi,
My I-94 which was issued 2 years ago in the port of entry got expired(this I-94 was based on my previous employer "ABC". I have applied for H1 extention and got my 797 extended with new I-94 recently with my new employer "XYZ".
My question is which I-94 details should I use while filing my 485. Obviously my labor was filed by "XYZ" company.

Guys,
Am trying to find out the relevant parts of HR 2892 that extends that benefit to EB cases.
Havent been able to find it?
Apart from Shusterman's commentary, I havent seen anything about the extension of benefits of the 'widow's penalty' to EB cases.
Maybe I am not looking at the right doc.
But those of you who have been able to see it in the statute/law, could you please point it out .....by sending the url, or noting the section/article of the law or any other way.

I dont feel that its a cosmetic change, while I agree that it can lead to some confusion. But there are orgs which have done it succesfully in the past. I thought it might give a better chance for us to give every one an idea abt what we are doing without getting on here or not coming her on to the website thingking "yet another org working for illegals"

People who go to IV will be redirected to LIV. I am not trying to take over and drive in a new direction. As I said, this might not be the exact need of the hour with congress in session. Core members can discuss this when they feel its pertinent.

I had the same situation and asked my attorney last month. He replied "I-94 # is always the # on the white card which is stapled in your passport", meaning the latest I-94 (white card) given to you at the port of entry. It doesn't matter whether it is expired or not. Hope this answers.
I think the I-94 Numbers should be the same on all I-94's.

Yes I am on EB2+PERM. Thanks for the explanation. I now understand the situation.
I have a couple of questions that will help me to figure out what to do:
1-When legally I can start applying for new EB2+PERM with the new employer? Can I start right away from day one or I should work for the new employer for a certain period?
2-What is the best way to have a safe H1B transfer? In other words should I ask my new employer to transfer H1B then resign from the current job once I received the new H1B or how it should be? Please advice.

I highly oppose calling those "Payed Services", but I am ok with "Paid Services" ;)
Like credit cards, it might be better to call them Gold Member services, or for high donation folks, Platinum Member services. "Paid" is used for a pre-determined service for a pre-determined price.

But in I485 document (page3) it has around 14 questions, during the interview do they ask all these questions verbally or do they just ask us sign this document or do they ask something else?
I heard they take oath from us, is that oath same as those questions in I485?

This is what my lawyer says about mergers:
If your job (description, location and salary) remains same or similar under the new company:
If the 485 has not yet been filed, you are required to amend the 140. You can file amendment and 485 together.
If the 485 is pending, in most cases do nothing. After 180 days, you are safe, anyway.
If your job has changed :
If 485 has not been filed, you are in trouble. You have to start the green card process over, but you keep your priority date if 140 is approved.
If 485 is pending for 180 days, the jobs need only be similar.

LOL! I did that already in May and the Local office IO was so incredibly RUDE and unhelpful. She told me absolutely nothing other than confusing me by saying my application was being processed on the East Coast and it would be another 3 months or so....... Bet she was just looking at the "EAC" in my receipt # to come up with "East Coast". I confirmed today it is definitely at TSC.
I am not surprised. USCIS/DHS employees have no accountability and utterly incompetent. They throw around national security whenever someone tries to hold them responsible.
They made a mess of those VSC-TSC, CSC-TSC, transfer cases and some are still waiting for their fingerprint notices.
